DeMint's homophobic voting record remains unsullied in latest judicial deal

     Senator Jim DeMint, who already says gay Americans shouldn't be school teachers, apparently thinks they shouldn't be federal judges, either. DeMint was one of six senators to oppose the confirmation of Michael Fitzgerald to a federal district judge in California today.
     Fitzgerald's nomination was approved unanimously by the Senate Judiciary Committee last November 11, but it took 133 days for Republicans to agree to allow a vote.
     Christianist political lobbying groups opposed Fitzgerald, apparently, for believing gay Americans have rights and can even exercise them in court.
     Another openly gay attorney, Edmund DuMont, withdrew his nomination for the DC Circuit Court of Appeals after it was denied a committee hearing by Republicans for 18 months. Two other out nominees have been confirmed to the federal trial bench under President Obama's administration. DeMint voted against both; Alison Nathan of New York,  on a 48-44 party line vote October 13, 2011, and J. Paul Oetken of New York, on an 80-13 vote July 18, 2011.
     DeMint also voted against the nomination of lesbian judge Marisa Demeo to the D.C. Superior Court in 2010.
     In a 2009 interview said the thought of a gay president made him cringe: “It would be bothersome to me just personally because I consider it immoral.”
     In a fit of pique over four recess appointments the President made in January, DeMint went further March 8 and announced he will oppose all the President's judicial nominations- including one of a Columbia lawyer to the federal court in South Carolina.
